§ 24-28. Possession of controlled substances.

  • (a)

    Generally. It shall be unlawful for any person to possess a controlled substance contrary to the Uniform Controlled Substances Act, Wis. Stats. ch. 961.

    (b)

    Possession of marijuana. No person shall possess 25 grams or less of marijuana, as defined in Wis. Stats. § 961.01, tetrahydrocannabinois or any derivative thereof, unless the substance was obtained directly from, or pursuant to a valid prescription or order of, a practitioner who is acting in the course of his professional practice, or unless the person is otherwise authorized by Wis. Stats. ch. 961 to possess the substance or the analog.

    (c)

    Penalties. Any person who violates this section is subject to a forfeiture of not more than $500.00. For a second or subsequent violation within 365 days of a previous violation hereunder, the forfeiture shall be up to $1,000.00.
