Chapter 22. MANUFACTURED HOMES, MOBILE HOMES AND PARKS |
Article I. IN GENERAL |
§ 22-2. Definitions.
The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Accessory structure means all structures constructed on a mobile home or trailer lot apart from the basic mobile home or trailer unit, and shall include awnings, cabanas, storage cabinets or sheds, carport windbreaks, attached porches and garages.
Common area means any area or space designed for joint use of tenants occupying the mobile home park or trailer park.
Dependent unit means a unit which does not have complete bathroom facilities and/or sanitary sewer connection.
Driveway means a minor private way used by vehicles and pedestrians of a mobile home or trailer lot or used for common access to a small group of lots or facilities.
License means a written license issued by the village allowing a person to operate and maintain a mobile home park or trailer park under the provisions of the chapter and regulations issued hereunder.
Lot area means the total area reserved for exclusive use of the occupants of a mobile home or trailer.
Manufactured home means any of the following:
(1)
A structure that is designed to be used as a dwelling with or without a permanent foundation and that is certified by the federal department of housing and urban development as complying with the standards established under 42 USC 5401 to 5425.
(2)
A mobile home, unless a mobile home is specifically excluded under the applicable statute.
Mobile home means a vehicle manufactured or assembled before June 15, 1976, designed to be towed as a single unit or in sections upon a highway by a motor vehicle and equipped and used, or intended to be used, primarily for human habitation, with walls of rigid uncollapsible construction, which has an overall length in excess of 45 feet. The term "mobile home" includes the mobile home structure, its plumbing, heating, air conditioning and electrical systems, and all appliances and all other equipment carrying a manufacturer's warranty.
Mobile home lot means a parcel of land for the placement of a single mobile home and the exclusive use of its occupants.
Mobile home park means a parcel, tract, or site of land, a minimum of three acres in size which is owned as an entity by an individual, firm, trust, partnership, cooperative association or corporation for the purpose of supplying a location or accommodation for two or more mobile homes with a permanent address. It includes all of the necessary service buildings associated with such an operation.
Mobile home stand means that part of an individual lot which has been reserved for the placement of one mobile home unit; it is that location which the home itself will physically occupy.
Nondependent unit means complete bathroom and toilet facilities (hot and cold water, shower/tub, toilet, and sanitary sewer connection), all furniture, cooking, heating, appliances and complete yearround facilities.
Park management means the person who owns or has charge, care or control of the mobile home park.
Park street means a private way which affords principal means of access to individual mobile home lots or auxiliary buildings.
Permit means a written permit or certification issued by the village board permitting the construction, alteration and extension of a mobile home park under the provisions of this chapter and regulations issued hereunder.
Person means any individual, firm, trust, partnership, public or private association, corporation, or licensee or agent of such person.
Public safety committee means the committee of the village board.
Service building means any building owned and maintained by the park owner for the purpose of conducting the business of operating the park, or for providing amenities for the tenants or guests, such as offices, gate houses, laundry buildings, and community halls.
Tenant storage area means a fenced or otherwise enclosed space designed to provide auxiliary general storage space for an individual mobile home occupier.
Trailer includes the following:
(1)
A vehicular, portable unit built on a chassis, designed as a temporary living unit for travel, recreation, and vacation, having a body width not exceeding eight feet and body length not exceeding 35 feet;
(2)
A living unit designed to be mounted on a truck chassis for use as a temporary dwelling for travel, recreation and vacation;
(3)
A portable, temporary living unit to be used for travel, recreation and vacation, constructed as an integral part of a self-propelled vehicle;
(4)
A canvas, folding unit mounted on wheels and designed for travel, recreation and vacation use.
Trailer park means a parcel, tract, site or site of land owned by a person which is designed, maintained, intended, or used for the purpose of supplying a location or accommodation for two trailers or recreational vehicles, not intended for long-term occupancy, with a permanent address at another location. It shall include all of the necessary service buildings associated with such an operation. The density of a trailer park shall not be greater than 15 lots per acre.
